Disaster victims are included in Abortion Law

Three Judges bench of Hon’ble D.Y Chandrachud. J, Hon’ble A.S Bopanna and J.B. Pardiwala. J. of the Hon’ble Supreme Court in its Judgement on Wednesday, take notice of woman fall prey of emergencies, find them separated and are victim of disasters.

During disasters it is difficult for victims to access medical facilities and obtain any knowledge about their pregnancies, in “Siddhi Vishwanath Shelar Vs. State of Maharastra”, (2021), victim during lockdown could not access the medical facilities and came to know about her pregnancy after 20 weeks. Because, every woman faces circumstances in their own unique manner therefore, it shall be the prerogative of a woman to evaluate about her life, according to her conditions, whether to carry her pregnancy or not.

In addition to this, apex court also said that in the eyes of law there shall be no discrimination whether a woman is married or unmarried.
